National Inspectorates - Estonia

In Estonia, the enforcement of REACH, CLP, BPR, POP and PIC Regulations is implemented under Chemicals Act and Biocidal Products Act, in which the organizations and responsibilities of respective enforcement authorities and their means of control are stipulated.

Authorities responsible for REACH and CLP enforcement

  • The Health Board – compliance with the obligations and requirements established by the REACH and CLP Regulations for the manufacturers and importers of substances and mixtures as well as compliance with requirements established for substances and mixtures at their manufacturer and importer and in retail and wholesale trade.
  • The Labour Inspectorate – compliance by downstream users with the requirements established by the REACH and CLP Regulations for downstream users of substances and mixtures and compliance on the downstream user’s premises with the requirements established to substances, mixtures and articles.
  • The Environmental Board – compliance with the labelling and packaging requirements established by the CLP Regulation and compliance with the requirement for registration and authorisation of substances established by the REACH Regulation, compliance with the chemical safety data sheet and the exposure scenarios set out therein, and adherence to restrictions established from the point of view of environmental hazardousness.
  • The Consumer Protection and Technical Regulatory Authority – compliance with the obligations and requirements imposed by Annex XVII to the REACH Regulation on the producers of articles as well as compliance with the restrictions for the placing on the market and use of articles.
  • Estonian Tax and Customs Board – participates in state supervision by verifying the import of a substance, mixture and article which is subject to a prohibition or restriction on placing on the market in accordance with Annex XVII to the REACH Regulation and other legislation.

Authorities responsible for BPR enforcement

  • The Health Board – compliance with the requirements established to making biocidal products and treated articles available; compliance with the requirements established to biocidal products and treated articles and the use of biocidal products by professional providers of pest control service, and in fields regulated by the Public Health Act and the Health Services Organisation Act.
  • The Labour Inspectorate – adherence to the requirements established to the use of biocidal products in the field regulated by the Occupational Health and Safety Act.
  • The Environmental Board – adherence to the requirements established to the use of biocidal products from the point of view of environmental hazardousness at the objects of supervision of the field.
  • The Agriculture and Food Board – adherence to the requirements established to the use of biocidal products from the point of view of animal health and the feed and food safety at the objects of supervision of the field.
  • Estonian Tax and Customs Board – adherence to the requirements established to making biocidal products available upon entering the Community market in accordance with Chapter VII of Regulation 2019/1020 on market surveillance.

Authorities responsible for POP enforcement

The responsibility for POPs Regulation enforcement is allocated to the Environmental Board and local governments or local government agencies.

Authorities responsible for PIC enforcement

  • The responsibility for PIC Regulation enforcement is allocated to The Health Board.
  • The Tax and Customs Board participates in state supervision by verifying compliance in accordance with Article 17 of the PIC Regulation with the requirements for the export and import of the chemicals listed in Annex I to the regulation and the requirements for the export of the chemicals listed in Annex V to the Regulation.
