ECHA is an EU agency, governed by EU public law. It has its own legal personality, but works together with the EU institutions, such as the European Commission, the European Parliament, the Council of the European Union, and with other EU agencies.

The European Parliament decides on the content and final adoption of legislation that governs and drives ECHA’s work. This is done together with the Council of the European Union, through a process known as ordinary legislative procedure.

The European Parliament is part of the EU's budgetary authority. It decides upon the available public funds and grants a 'discharge' or final approval of ECHA’s budget for a given year. Also, its Committees on Budgets (BUDG) and on Budgetary Control (CONT) may deal with issues related to ECHA’s budget.

The Committee for Environment, Public Health and Food Safety (ENVI) follows ECHA’s activities closely and invites the Agency’s Executive Director to an annual exchange of views. ECHA may also be invited to other meetings of European Parliament Committees when its scientific-technical input is requested. In addition, the ENVI Committee may designate a contact person for the Agency.
The European Parliament appoints two independent persons to ECHA’s Management Board.
