Please read carefully the following terms and conditions of echa webforms for the purpose of notifying an intention to submit an application for authorisation and for requesting a teleconference based information session

By ticking the "I accept" box on the webforms page you agree to these Terms and Conditions (Terms). The European Chemicals Agency (ECHA) reserves the right, in its sole discretion, to change, modify, add or remove portions of these Terms at any time. By using the webforms after we post any changes to these Terms of use, you agree to accept those changes, whether or not you have reviewed them. If you do not agree to these Terms, you cannot use the webforms.

 

1. The webforms for requesting a teleconference based information session

 
The webforms provide an online platform to notify your intention to submit an application for authorisation and to request a teleconference based information session in order to discuss issues connected to the filing of an authorisation application. 
 
For the purposes of the teleconference based information session, ECHA shall be permitted to access, reproduce, review, use, extract, and store any of the information submitted through these webforms. 
 

2. Warranties

 
ECHA has made utmost efforts to ensure that the webforms will perform substantially in accordance with the REACH Regulation and will operate correctly.
 
By submitting any information through the webforms you warrant that you hold all necessary rights with regard to the information provided, including but not limited to copyright where applicable and, therefore, that you are entitled to submit the said information for the purposes listed herein and for its use by ECHA.
 
Content and materials of the webforms are provided "as is" without warranty of any kind, either express or implied including, but not limited to, any implied warranty against infringement of third parties property rights, of merchantability and fitness for a particular purpose.
 
The entire risk as to the use, quality, and performance of the webforms is with you. In no event, will ECHA be liable for any incidental, consequential, direct or indirect damages including but not limited to the loss of data, loss of profits, or any other financial loss arising from the use of, or inability to use webforms, even if you have been notified of the possibility of such damages.
 

3. Conditions of use

 
You are entitled to use the webforms with a view to notify your intention to submit an application for authorisation and to request a teleconference based information session with the aim to discuss certain issues with regard to the process of filing an application for authorisation under Title VII of the REACH Regulation.
 

4. Data Protection

 
By accepting these Terms of service you also warrant that, in the event you intend to provide personal data within the meaning of Regulation (EC) No 45/2001 (on the protection of personal data by the Community institutions) and/or national legislation implementing Directive 95/46/EC (on the protection of individuals with regard to the processing of personal data and the free movement of such data) you have obtained the consent from the owner of that personal data that his/her data may be processed for the purposes of Title VII of the REACH Regulation. If you have not obtained such consent from that person you should not provide ECHA with his/her personal data.
 
4.1 Use and access of personal data 
 
Within the framework of the authorisation webforms personal data provided by you is dealt with by ECHA in compliance with Regulation (EC) No 45/2001 of the European Parliament and of the Council of 18 December 2000
 
The data provided is used to ensure that ECHA can process your request for a teleconference based information session and for resource planning purposes only. 
 
4.2. How long do we keep your data?
 
Your personal data is kept as long as follow-up actions are needed resulting from the fact that you have made a notification of intention to submit an application for authorisation and have requested a teleconference based information session.

5. Miscellaneous provisions

 
The Terms shall be governed by and construed in accordance with the Finnish law.
 
Any dispute, controversy or claim arising out of or relating to these Terms shall be settled by adjudication before the competent courts of Helsinki.
 
However, ECHA reserves the right to seek all remedies available in law and in equity for violation of the present Terms and/or applicable legislation.
