Appeal against substance evaluation decision dismissed
In case A-009-2021, the appellant contested a decision which followed the second substance evaluation of resorcinol regarding its potential endocrine disrupting properties for the environment.
The first substance evaluation of resorcinol had not been concluded by the adoption of a decision under Article 52 of the REACH Regulation. Therefore, the specific conditions set out in Article 47(1) of the REACH Regulation for reopening the substance evaluation were not applicable.
The Board of Appeal decided that ECHA did not err in requesting a Larval Amphibian Growth and Development Assay to further investigate potential endocrine disrupting properties for the environment.
BoA Chairman dismisses appeal as inadmissible
In case A-012-2022, the Chairman of the Board of Appeal has dismissed as inadmissible an appeal against a document entitled ‘Assessment of regulatory needs, group name: Aralkylaldehydes’. The Chairman held that this document is not one of the decisions on which the Board of Appeal is competent to decide.
