How to keep IUPAC names confidential in the Classification and Labelling Inventory

Instructions are now available as announced in the News Alert on 13 August to assist companies in keeping the IUPAC name of substances confidential in classification and labelling notifications.

Helsinki, 13 September 2010 - The new instructions are relevant for companies registering their substances later than the 2010 REACH registration deadline and for those who place low-volume hazardous substances on the market and therefore have to notify the C and L of their substances to ECHA as of 3 January 2011.

The IUPAC name can be considered confidential and thus not be made public in the C and L inventory if the substance is:
· a non-phase-in substance (less than one tonne),
· a substance only used as:
- an intermediate and/or
- in scientific research and development and/or
- in product and process oriented research and development

IUCLID is the sole notification tool allowing companies to ask for the IUPAC name to be kept confidential. In the IUCLID dossier the notifier has to provide a justification including a clear declaration that the substance is a non phase-in substance, a chemical intermediate, a R&D or a PPORD substance.

An alternative name has to be provided for dissemination of the classification of the substance via the ECHA website. This name for public disclosure should be derived using the methodology from Directive 67/548/EEC.There is no fee for submitting such a C&L notification with an alternative name.
