Registry of restriction intentions until outcome

The registry of restriction intentions until outcome lists the intentions and Annex XV restriction proposals received by ECHA.

A restriction proposal may be prepared by a Member State or by ECHA at the request of the Commission or on its own initiative for substances in the Authorisation List. It is a legal requirement for a Member State to notify ECHA of its intention to prepare a restriction dossier. The advance notice enables interested parties to plan and prepare for commenting later on.

Interested parties can follow the progress of a proposal through the restriction process, from the notification of the intention to the adoption of the final opinions by the Committee for Risk Assessment (RAC) and the Committee for Socio-economic Analysis (SEAC), and the adoption of the restriction by the European Commission.

Stakeholders are encouraged to submit any relevant information to the dossier submitters during the preparation of the restriction proposal and during the consultations. Information to motivate any exemptions to the scope described in the intention is particularly useful to receive in the preparatory phase of the dossier.

Details on the scope of restriction
Shall not be placed on the market or used in concentrations equal to or greater than 0.1% by weight of each in personal care products that are washed off in normal use conditions.

Personal care products shall be taken to mean any substance or mixture intended to be placed on contact with various external parts of the human body (epidermis, hair, nails, lips and external genital organs) or with the teeth and the mucous membranes of the oral cavity with a view exclusively or mainly to cleaning them, perfuming them, changing their appearance and/or correcting body odours and/or protecting them or keeping them in good condition.

Normal use may be determined by packaging instructions, indicating the purpose of the product and how it shall be used.
Reason for restriction
D4 and D5 are two siloxanes that have PBT (D4) and vPvB (D5) characteristics. Each has a range of generally similar uses. A particular concern is the release of these substances into freshwater and their subsequent persistence and build-up in sediments, followed by bioaccumulation through the food chain. One significant use that results in emission of these substances into water is via their presence in wash-off personal care products. A restriction of this use would make a significant contribution to reducing their presence in water sediment. This targetted approach would be more appropriate than alternative regulatory approaches that would be less targetted and would encompass numerous other use situations of lesser concern.
