Calls for comments and evidence allow interested parties to signal their interest and express their views and concerns in the preparatory phase of the restriction proposal. They also let interested parties comment on the different documents under preparation in ECHA in relation to restrictions, such as reports on substances in articles and guidelines on restriction entries.

Additional information to justify or support comments made is also welcomed. The information gathered will provide an input into developing Annex XV restriction dossiers or other documents. When we open a call for comments and evidence, we intend to give parties who otherwise might not have been identified and consulted a chance to submit information.

The calls for comments and evidence do not take the place of the public consultation on restriction proposals developed by Member States or ECHA, which forms a standard part of the restriction process.

Objective of the call

The Commission requested ECHA to prepare an investigation report to support the preparation of a restriction proposal on the use of CMR 1A or 1B substances in childcare articles (CCA) on the basis of Article 68(2) of REACH.

ECHA has identified the need for further evidence of the presence of relevant (groups of) CMR 1A or 1B substances in specific types of childcare articles and for additional information.

The objective of this call for evidence is to gather information on:
  1. verification, complementation and/or correction of the categorisation of CCA
  2. verification, complementation and/or correction of the information complied by ECHA on the presence or absence of individual CMR 1A or 1B substance in CCA, type of article and material analysed, and technical function and measured concentration of the CMR substance in CCA
  3. information on existing certification schemes, standards, company or sector specific ‘restricted chemicals lists’ requirements in CCA
  4. information related to the intentional or unintentional presence of CMR 1A or 1B substances in CCA
  5. information on available analytical methods to measure CMR 1A or 1B substances in CCA and on foreseen challenges to detect and verify the presence of such CMR substances in CCA
  6. information on existing risk assessments targeted to the exposure of children to CMR 1A or 1B substances in CCA
  7. any other relevant information
Target group
Companies, industry associations, consumer protection associations, laboratories, and other organisations (including Member States) with an interest in childcare articles are invited to provide information.
