Calls for comments and evidence allow interested parties to signal their interest and express their views and concerns in the preparatory phase of the restriction proposal. They also let interested parties comment on the different documents under preparation in ECHA in relation to restrictions, such as reports on substances in articles and guidelines on restriction entries.

Additional information to justify or support comments made is also welcomed. The information gathered will provide an input into developing Annex XV restriction dossiers or other documents. When we open a call for comments and evidence, we intend to give parties who otherwise might not have been identified and consulted a chance to submit information.

The calls for comments and evidence do not take the place of the public consultation on restriction proposals developed by Member States or ECHA, which forms a standard part of the restriction process.

Call for evidence (uses and alternatives) on certain hexavalent chromium substances to support the preparation of a restriction proposal
Objective of the call

ECHA intends to submit an Annex XV Restriction Dossier on certain hexavalent chromium substances: any of the Cr(VI) substances listed on REACH Annex XIV (except the lead chromates), and barium chromate (EC: 233-660- 5).

For this restriction preparation, a first call for evidence was held from December 2023 until February 2024. The purpose of this second call for evidence is to close gaps from the first one and inquire about additional elements identified in the meantime.

This call for evidence is composed of two separate surveys (see links below) and is intended to support the preparation of the Restriction Report, and to gather information on:

  • Various uses of Cr(VI) substances (survey 2a)
  • Alternatives to Cr(VI) substances (survey 2b)

Target group

The survey 2a targets companies using Cr(VI) substances and in particular:

  • Any company that did not respond to the first call for evidence
  • Users of Cr(VI) substances in the transportation (maritime, rail, road, aviation), aerospace and defence sectors
  • Users of Cr(VI) in electroplating on plastics, painting, spraying, brushing and slurry coating, and speciality surface treatment incl. chemical conversion coating, anodization and passivation
  • Users of Cr(VI) substances other than chromium trioxide and chromium acids including users of barium chromate.

Companies that already responded to the first call for evidence are therefore kindly asked not to provide the same information again to eliminate the risk of any double counting of answers.

The survey 2b targets providers (e.g. manufacturers, formulators, suppliers, importers, distributors) of alternative(s) to Cr(VI) substances as well as to companies that have substituted Cr(VI) substances or are just completing such substitution.

This call for evidence is addressed to interested parties including but not limited to private companies, sector associations, scientific organisations, NGOs and other stakeholders or Member State Authorities holding relevant information. Both EU/EEA and non-EU stakeholders are encouraged to participate.

Information can be submitted confidentially and will be treated as such by ECHA.
