JUSTIFICATION FOR DATA WAIVING
The specific test material in question is a gas rather than a solid or liquid material and as such is out of the applicability of this test design (OECD 209). Having looked at options to modify the test design to allow the test to be conducted, the following reasons led to the conclusion that the test is not scientifically feasible:

A requirement of the test is to constantly aerate the media; the aeration will displace the test item in the media.

Any modifications made to add the test item to the media in a sealed vessel well will result in the test item displacing the oxygen and this would potentially make it an anaerobic test.

Toxicity is measured as a function of oxygen consumption - therefore modification of the dissolved oxygen levels will skew the results and make it difficult to interpret the outputs.

Gicen the reasons above, it is not possible or scientifically justifiable to conduct a OECD 209 test as results would not be representative of any actual exposure.
