JUSTIFICATION FOR DATA WAIVING
According to REACH Annex IX, 9.1 (aquatic toxicity), long-term testing shall be proposed if the chemical safety assessment indicates the need to investigate further the effects on aquatic organisms. The studies available indicate that in acute aquatic toxicity tests at 3 trophic levels there are no effects up to the limit of water solubility. Furthermore, in the two available long-term toxicity studies on Daphnia magna and algae, no adverse effects were identified at levels orders of magnitude higher than the limit of solubility, thus no environmental hazard was identified. Considering these results, testing on higher organisms, i.e. vertabrates, is scientifically unjustified (Annex VIII, 9.1.3) as substantial evidance suggests no adverse effect will occur during long term testing at the limit of solubility or at environmentally relevant exposure levels. This is further supported by a 14 d prolonged toxicity test conducted at 40 mg/L - this limit concentration determined when a dispersant was used, which showed no mortality or adverse effects.
