Statement of Strictly Controlled Conditions – Chemtura Italy S.r.l.

Chemtura Italy S.r.l. are committed to the safety and health of employees, the protection of plant and equipment and the safety of the surrounding community and the environment. Chemtura is committed to Responsible Care®, the chemical industry's voluntary initiative to protect the environment; ensure the safety and security of its operations; and safeguard the health and safety of employees and the communities in which people live and work. Under Responsible Care, Chemtura Italy S.r.l pledge to be stewards of our products from manufacturing and handling to transport and disposal.

New program enhancements adopted by the American Chemistry Council as a condition of membership include:

1. A Responsible Care Management System (RCMS);
2. An independent third-party certification of the management system to ensure appropriate actions are taken to improve performance;
3. Tracking and publicly reporting performance based on economic, environmental, health and safety, societal and product-related metrics; and
4. A Security Code that helps protect people, property, products, processes, information and information systems by enhancing security throughout the chemical industry value chain.

The Chemtura Responsible Care Management System (RCMS) includes some 100 management practices that are based on the best practices of leading private sector companies; initiatives developed through the Global Environmental Management Initiative, International Standards Organization and other bodies; and requirements of national regulatory authorities. Chemtura's RCMS has been externally registered to the internationally recognized RC14001 standard and is being implemented globally.

As a framework to ensure that Strictly Controlled Conditions are maintained within the site, Chemtura Italy S.r.l operate a balance of management systems and technical procedures to ensure that strictly controlled conditions are maintained through the operation of substances that fall within the scope of “intermediates” for the purposes of REACH. Chemtura Italy S.r.l operate various environmental and safety controls are subject to a range of European and national legislation with respect to safety, environment, and worker protection. Our operation encompasses relevant parts of such legislation as:
• Chemical Agents Directive (chemical substances) 98/24/EC
• ATEX (working flammable atmospheres) 99/92/EC
• IPPC (Environmental Control) 96/61/EC
• Seveso Directive* (control of major accidents) 96/82/EC
Chemtura Italy S.r.l operate to derivations from this legislation. In this context, all industrial operations are required to have an emergency plan with provision for fire drills and training etc.
Chemtura Italy S.r.l understand that, for the purposes of REACH registration, the requirement is to confirm that Strictly Controlled Conditions applies to the Site Limited Isolated Intermediates that Chemtura Italy S.r.l utilise in order that the substance is only manufactured and used under strictly controlled conditions in that it is rigorously contained by technical means during its whole lifecycle. Control and procedural technologies shall be used to minimise emission and any resulting exposure.

Chemtura Italy S.r.l note Strictly Controlled Conditions (SCC) are defined under REACH Article 17(3) and are as detailed above. As such, Chemtura Italy S.r.l confirm as follows:

That the substance is rigorously contained by technical means during its whole lifecycle including manufacture, purification, cleaning and maintenance of equipment, sampling, analysis, loading and unloading of equipment or vessels, waste disposal or purification and storage;

Chemtura Italy S.r.l can confirm that processes are conducted within closed systems within our plant, with control procedures in place that are rigorously adhered to. The general process covers:

Production outside the EU: closed reactors

The registered substance is produced under closed conditions within dedicated scrubbers. The substance is then transferred by closed system pumps to the storage vessels for transportation under secure conditions. Import into the EU is in sealed containers.

Reaction of the intermediate: closed reactors

The registered substance is transferred directly from the storage vessels via dedicated closed pumping system directly to the reaction vessel, where it is subsequently consumed in the relevant reaction process.

Sampling following reaction process:

Chemtura Italy S.r.l document systems and technical measures used for sampling and analysis, and only trained personnel are involved in this operation. It is not possible to perform sampling under "closed system conditions", so we operate a practical system of sampling by trained personnel that includes segregation of the facility during sampling exercises, local ventilation, and use of appropriate PPE for the task at hand.

Cleaning/Maintenance works

All cleaning works are conducted in compliance with the site licence conditions. All discharges are managed within licensed condition limits, and all waste disposed of with the limits set down by the European waste legislations. Cleaning and purging to waste are essentially automated procedures, with all wastes captured for subsequent disposal as chemical wastes.

Maintenance works are only carried out on cleaned equipment using an internal “permit to work” system which is enacted following completion of a suitable risk assessment. Such authorisation procedures and work permits are documented internally within Chemtura Italy S.r.l.

All wastes are collected and sent for disposal in accordance with national legislation and our site disposal permitted conditions. This is generally via neutralization and/or incineration by a licensed waste disposal contractor.

Only properly trained and authorised personnel handle the substance;

Chemtura Italy S.r.l confirm that the substance is handled only by properly trained and authorised personnel under closed system conditions. Chemtura Italy S.r.l operate company training procedures, with regular assessments of our staff to ensure that training is maintained. The company training programme incorporates any provision for individual assessment and qualification or authorisation for more demanding tasks. Training in use of personal protective equipment (PPE) and emergency procedures and drills is also included. Employees trained for specific roles are documented, and authorised to operate specific tasks after completing certain stages of training. Technical measures put in place to implement these systems.

Training procedures are documents and communicated to employees via the "company employee handbook". This include specific training on handling and usage of chemical substances, classification and labelling, safety and the proper use of personal protective equipment.

In cases of accident and where waste is generated, procedural and/or control technologies are used to minimise emissions and the resulting exposure during purification or cleaning and maintenance procedures;
As discussed above, generation of waste is covered by the site license and disposal requirements, and this is strictly adhered to. In the case of accident, Chemtura Italy S.r.l operates under the principles of the Seveso Directive (control of major accidents) 96/82/EC, with documented procedures to allow for adequate response.
As part of staff training, emergency measures are detailed, and appropriate training provided to allow for adequate steps for remediation and minimisation of the impact of such an accident. All wastes from accidental releases are contained within the site, which is specifically designed to ensure containment, and any waste from such releases are treated as chemical wastes, and disposed of accordingly.
Substance-handling procedures are documented and strictly supervised by the site operator.

If special handling procedures are required for a particular substance, Chemtura Italy S.r.l operates a documented system and technical measures to allow for such handling. These measures are cross references to our overall systems as discussed above. Appropriate operator training is provided and if it is not possible to work in a closed system, that another suitable system is designed and documented. Technical measures are put in place to implement these systems following risk assessment, and are conducted and strictly supervised by the site management.


On the basis of the procedures operated by Chemtura Italy S.r.l, Strictly Controlled Conditions are adhered to, and registration of the substance as an intermediate is appropriate.
