REACH

Report on REACH and CLP implementation

ECHA will publish its report on the implementation of REACH and CLP on 26 May. The report provides a picture of the impact, success and remaining challenges of implementing the European chemicals legislation. It also makes commitments and gives recommendations to the European Commission, Member States and industry.

New version of Chesar available in June

The new release date for the update of Chesar is 21 June 2016. On the same day, a Chesar 3 webinar will take place. Those taking part in the webinar will be given access to the application beforehand. So, if you are still planning to register for the webinar, do so soon. A minor update of IUCLID 6 will also be published, which will ensure compatibility between IUCLID 6 and Chesar 3. Chesar 3 users will need to install this update.

Check which REACH guidance will still be updated

A list of REACH guidance documents still subject to change before the last registration deadline is now available. ECHA will apply a two-year ‘moratorium' on updates to the majority of the Agency's guidance on REACH before the 31 May 2018 deadline. The moratorium on updates is set to begin on 31 May 2016. ECHA has published a list of the REACH guidance documents that are or will be under consultation, and not part of the standstill.

Already using IUCLID 6? Get familiar with the support material

Did you know that the new version of IUCLID also includes the ECHA user manuals within the tool? Just press F1 anywhere inside IUCLID 6 and the help system opens. You will have access to information on all the IUCLID 6 functionalities and the manuals on how to prepare different REACH and CLP dossiers. The same manuals are also available on ECHA's website, together with a technical document on how to adapt existing IUCLID 5 data to the new IT tools. The manuals will gradually be available in 23 EU languages. Keep in mind that after the release of the updated REACH-IT on 21 June, you can only submit dossiers created with IUCLID 6. Until then, you must continue to use IUCLID 5.

Guideline for lead in consumer articles published

At the request of the European Commission, ECHA has prepared a guideline on implementing new restriction provisions on lead and its compounds in articles supplied to the general public. The guideline aims to assist producers, importers, distributors, and users of articles, as well as Member State competent and enforcement authorities, to understand and comply with their obligations.

Study on fish embryo toxicity test published

ECHA has commissioned a study to analyse data on fish embryo toxicity (FET). It was compared with available data on standard acute fish toxicity (AFT), and parameters were set up to define the applicability domain and limitations of an FET test in comparison to AFT. The outcome gives a basis to understand how the FET test might be used in the regulatory context of REACH.

Submit substance in article notifications by June 2016

The deadline for submitting substance in article notifications on five substances of very high concern, which were added to the Candidate List in December 2015, is 17 June 2016. The information provided below on the type of articles/materials that may contain the substances is based on REACH data and is not exhaustive.

  • 1,3-propanesultone (EC 214-317-9; CAS 1120-71-4). May be found in lithium-ion batteries as electrolyte fluid additive.
  • 2,4-di-tert-butyl-6-(5-chlorobenzotriazol-2-yl)phenol (UV-327) (EC 223-383-8; CAS 3864-99-1). May be found in surface coatings, plastics and rubber as UV-protection agents.
  • 2-(2H-benzotriazol-2-yl)-4-(tert-butyl)-6-(sec-butyl)phenol (UV-350) (EC 253-037-1; CAS 36437-37-3). May be found in surface coatings, plastics and rubber as UV-protection agents.
  • Nitrobenzene (EC 202-716-0; CAS 98-95-3).
  • Perfluorononan-1-oic-acid and its sodium and ammonium salts (PFNA and its salts) (EC 206-801-3; CAS 375-95-1, 21049-39-8, 4149-60-4). May be found in gloves, leather, paper-based food contact materials, liquid crystal display (LCD) panels and textiles. They are used in the production of these articles as e.g. cleaning agents, textile antifouling finishing agents, polishing surfactants and waterproofing agents.

Importers and EU producers of articles are invited to check if these substances in their articles meet the conditions for the notification obligation under Article 7 of REACH. The notification can be submitted through the "substance in article" webform, or through REACH-IT using IUCLID.

Board of Appeal

New Board of Appeal decision in case A-010-2014 on intermediates

In Case A-010-2014, the appellant contested an Agency compliance check decision finding that diarsenic trioxide, as used in the appellant's plant, does not qualify as an intermediate and therefore cannot benefit from the reduced registration requirements, and other exemptions, that apply to intermediates under the REACH Regulation.

The Board of Appeal decision examines the rules in REACH regarding the definition of intermediates and the criteria that need to be met for a registered substance to qualify as an intermediate.

The Board of Appeal annulled the contested decision on the grounds that the Agency misinterpreted the criteria that apply under Article 3(15) of the REACH Regulation for a substance to be considered to be an intermediate. The Board of Appeal remitted the case back to the Agency for re-evaluation.

Practical Guide 13 How downstream users can handle exposure scenarios has been revised. The content has been updated and some material, which is now described more fully in other ECHA guidance and practical guides, has been removed to reduce duplication. The practical guide will be available in 23 languages later in the summer.

IUCLID administrator webinar: switching from IUCLID 5.6 to IUCLID 6
1 June 2016, 11:00-13:00 EEST (GMT+3)

The webinar will cover server administration for multiple users, new user management features including ‘Instance Based Security' (IBS), merging several IUCLID 5 installations into one IUCLID 6 database and tips for migrating your data. Presentations will be followed by a question and answer session.

This webinar is intended for advanced users of IUCLID.

Workshop on Socio-economic analysis in applications for authorisation and restriction under REACH

ECHA and the European Commission (Directorates-General Internal Market, Industry, Entrepreneurship, SMEs and Environment) will organise a workshop on socio-economic analysis in applications for authorisation and restriction under REACH on 29 June 2016.

This event aims to clarify the role of socio-economic analysis (SEA) under REACH and is aimed at Member States, European Parliament and stakeholders.

To develop the programme for the workshop ECHA is conducting a survey on SEA. Anyone involved in the REACH authorisation and restriction processes are invited to complete the survey.

OECD Workshop – Socio-economic impact assessment of chemicals management
6-8 July 2016
Helsinki, Finland

This workshop is organised by ECHA together with the Organisation for Economic Cooperation and Development (OECD). The event aims to take stock of and pave the way for increased collaboration in sound chemicals management. Participants will discuss and share experiences between regulators, industry, academia and other stakeholders on assessing the socio-economic impacts of chemicals management.
