Act well before the deadline in data sharing dispute cases!

ECHA reminds companies who are experiencing difficulties in negotiating access to information within their SIEF that, in case of disagreement, it is necessary to launch the decision-making process under REACH by using webforms to inform ECHA on the dispute. This needs to be done before submitting your registration dossier.

In order not to face significant consequences related to the validity of your registration, it is stressed that in the case of data sharing dispute you should not submit an incomplete dossier to ECHA (e.g. by including invalid 'data waivers' in the endpoint study record section of your IUCLID 5 dossier) without ECHA's prior approval. Being in a data sharing dispute is a temporary situation which cannot justify permanent data gaps in a registration. If you find yourself in this situation, you need to follow the specific procedure of REACH Article 30(3). After using the webform, the decision from ECHA will also include advice on how to present the situation in your IUCLID 5 dossier, depending on the specific circumstances.
