According to Annex VII of the REACH Regulation (EC 1907/2006), the study on toxicity to aquatic plants does not need to be conducted if there are mitigating factors indicating that aquatic toxicity is unlikely to occur, for instance if the substance is highly insoluble in water.

Disperse Red 202 is found to be highly insoluble in water, with water solubility below LOD/LOQ of 1.08 mg/l.

Similarly, Similar Substance 01 has also a very low solubility in water, i.e. below the LOQ of 5 µg/l; moreover, in the validation of analytical method for Similar Substance 01, solubility in 20x AAP medium was found to be below LOQ.

Based on the structural similarity, the same behaviour in 20x AAP medium is expected for Disperse Red 202.

Overall, the significance of studies run at concentrations below LOQ was considered as low and the aquatic compartment was considered as not target of the substance toxicity.
