Directive 2011/65/EU of the European Parliament and of the Council of 8 June 2011 on the restriction of the use of certain hazardous substances in electrical and electronic equipment (recast)

Scope

Subject/purpose: This directive lays down rules on the restriction of the use of hazardous substances in electrical and electronic equipment (EEE) with a view of contributing to the protection of human health and the environment. (Art.1) Scope: This directive applies to EEE falling within the categories set out in Annex I, except equipment specifically excluded in Art. 2 (4).

Exemptions

Exclusions are defined in Art. 2 (4) of the Directive: (a) equipment for military/security purposes (b) equipment designed to be sent into space (c) specifically designed equipment as a part of excluded equipment (d) large-scale stationary industrial tools (e) large-scale fixed installations (f) means of transport for persons or goods, excluding not type-approved electric two-wheel vehicles (g) non-road mobile machinery for professional use (h) active implantable medical devices (i) PV panels (j) R&D equipment Furthermore, time-limited substance and application specific exemptions are listed in Annexes III and IV.

Yes. Annex I - Categories of EEE covered by the Directive.However, it needs to be highlighted there is no 'fixed list' of equipment belonging to each category, for example, 'large household equipment'.

As per Art. 5 (8), the Commission adopts harmonised format for applications for granting, renewing and revoking an exemption made in accordance with Anne V.
