A toxicity data waiver applies since the submission substance falls in the 100-1000 tonnage category for REACH submission, which does not require toxicity testing in birds. In addition, in accordance with ECHA 2008 Guidance on information requirements and chemical safety assessment, Chapter R7.c. Endpoint Specific Guidance, the toxicity to bird study does not need to be conducted since the submission substance, CAS No. 70225-05-7, is not expected to pose a secondary poisoning risk and is expected to be inherently biodegradable and have a low bioaccumulation potential. Trimellitate esters including the submission substance are expected not to be acutely or chronically toxic in mammals (see Section 7) and hence, are not expected to pose an acute or chronic hazard to birds.
