JUSTIFICATION FOR DATA WAIVING
In accordance with REACH Regulation (EC) No. 1907/2006 Annex VII, column 2 section 7.6 the study need only to be conducted if based on structure: surface activity is expected or can be predicted. The substance constituents that are soluble > 1 mg/L are not predicted to be surface active at 20°C. The applicant is aware of measured data on those constituents and structural analogues agreeing with this conclusion. Other constituents within the substance that have the potential for surface activity are not soluble in water > 1 mg/L at 20°C. Since the constituents in question are outside the solubility limits of the applicable guidelines their contribution to the substance surface activity within the test method is questionable. Expert assessment indicates that these constituents would not be expected to be solubilised sufficiently at 90% saturation relative to the non-surface active constituents; in order to yield a positive result for surface activity (surface tension < 60 mN/m). This conclusion is confirmed by measured data within partition coefficient and water solubility endpoints. According to ECHA Guidance on Information Requirements and Chemical Safety Assessment (Chapter R.7a: Endpoint Specific Guidance, R.7.1.6, July 2017) the study does not need to be conducted.
