The bioconcentration factor of bis(2 -ethylhexyl)maleate was calculated according to the requirements stated in the IR & CSR by using a bilinear formula which is recommended for substances with a log Pow above 6. The resulting BCF value of 4073.8 L/kg indicates that bis(2 -ethylhexyl)maleate has the potential to bioaccumulate in the aquatic environment, and hence fulfils the "B" criterion as defined in the legislation. As the calculated BCF value is clearly above the BCF value of 2000 L/kg triggering the "B" criterion, it is assumed that an in vivo testing would also result in a value clearly above 2000 L/kg. Due to animal welfare reasons, it is not justified to conduct a test just for the confirmation of already existing data. Besides this, bis(2 -ethylhexyl)maleate is used exclusively as intermediate or monomer, respectively, where only low release into the environment can be expected. Also for this reason it is justified not to conduct an in vivo bioaccumulation study.
