In the short acute fish toxicity test performed on Solvent Brown 41, no effect were observed at the loading rate of 100 mg /l (LC50=NOEC=100 mg/l nominal or 0.74 mg/l measured); precipitation is observed and the measured concentration in the test system is about 0.74 mg/l. Analogously for the acute toxicity to aqautic invertebrates, in particular on Daphnia Magna, no effects were observed at the 100 mg/L loading rate (corresponding to a measured concentration is 1.24 mg/l). Due to the insolubility of the substance in water a test for assessing acute toxicity on aquatic plants, in particular algae, has been considered as not applicable and representative. In fact, based on the REACH Regulation, Annex VII, Column 2 (specific rules for adaptation from column 1) the algae study does not need to be conducted if there are mitigating factors indicating that the aquatic toxicity is unlikely to occur, for instance if the substance is highly insoluble in water (< 0.1 mg/l). The solubility of Solvent Brown 041 estimated by EPIWEB* is 0.018 mg/L.
Therefore, for Solvent Brown 041 it is not be possible to undertake a full quantitative risk assessment, as a PECwater/PNECwater ratio, since it is not possible to calculate a PNECwater.
The Guidance on information requirements part E 4.4, however, recommends to conduct a qualitative risk assessment in order to decide whether further long-term toxicity testing is required. The qualitative assessment is mainly based on the estimated Log Kow (Log Kow = 2.26) which is < 3 and the potential for bioaccumulation (Estimated BCF = 1 << 500 ).
No long-term toxicity testing is then proposed and no assessment for the eco-compartment is performed.
Conclusion on classification
Solvent Brown 41 is an insoluble substance for which no acute toxicity is possible to record at levels up to the water solubility , and which is not rapidly degradable in accordance with section 4.1.2.9.5. However, it has not a BCF > 500 or LgKow > 4 and therefore does not suggest potential to bioaccumulate in a long-term toxicity study.
For the substance is therefore proposed as safety net classification as Aquatic Chronic 4, H413: May cause long lasting harmful effects to aquatic life under Regulation 1272/2008.
