According to the REACH Regulation n. 1097/2006, Annex VII, Column 2: " The study does not need to be conducted if there are mitigating factors indicating that aquatic toxicity is unlikely to occur, for instance if the substance is highly insoluble in water or the substance is unlikely to cross biological membranes".

Data on an analogue substance (similar substance 01) are however available and was taken into account due to the high similarity with the target substance. More details on the similarity between the two substances is reported in section 13.

The substance is highly insoluble in water, therefore this study should have been waived. However, a non-GLP preliminary experiment was carried out at saturation concentration to determine the approximate toxicity of the test item. For preparation of the test solution a supersaturated solution (100 mg/L nominal loading).Based on the results of this non-GLP preliminary test, the test item had no toxic effect on Daphnia magna at aquatic saturation. The 48h EC50, and NOEC values can be determined to be higher than saturation.
