The CLP Regulation states that a substance for which adequate chronic toxicity data are not available, for which the 72 or 96 hr ErC50 (for algae or other aquaticplants) is ≤ 1 mg/l and which is not rapidly degradable must be classified for hazardous to the environment chronic category 1 with H410 (very toxic to aquatic life with long lasting effects) and M-factor = 1
