Transitional measures: complementary part to the CoRAP

These transitional measures refer to those substances for which further information has been requested from a notifier/manufacturer/importer. These requests are in accordance with Article 16(1) of Directive 67/548/EEC (for NONS substances) or Articles 10(2) or 12(2) of certain Commission regulations that have been adopted in application of Regulation (EEC) No 793/93 (for existing substances). However, not all the information was provided by the stated deadlines or evaluation was not complete by the responsible Member States Competent Authority (MSCA), thus the substance evaluation process was ongoing.

Prior to the REACH Regulation, Member States Competent Authorities (MSCAs) were responsible for the evaluation of certain substances or dossiers under the previous chemicals legislations. For some of these substances, there were still outstanding information requests in the form of Commission regulations (for existing substances) or decisions prepared by MSCAs under Directive 67/548/EEC (for NONS substances). However, these shortcomings have been resolved, no outstanding information requests are pending and the MSCAs have concluded the evaluation of the substances subject to transitional measures.

After the evaluation was completed, the MSCAs have considered follow-up actions to substance evaluation for these substances. For example, such actions could have been:

  • Identification as a Substance of Very High Concern (SVHC) and subsequently a need for authorisation
  • A restriction proposal
  • A proposal for harmonised classification and labelling
  • Need for other Community-wide measures
  • Need for action at national level or voluntary action by industry
 

Outstanding information requests for notified substances

There are no longer any outstanding requests for notified substances originating from Directive 67/548/EEC.

These are the existing substances for which manufacturers and importers are required to submit additional information.
