Justification:

Results from valid EPI suit indicate that 3,3 diphenylpropiononitrile  has a low predicted Log Kow at 3.17.  This low Log Kow (less than 4.5) is an indication that the substance is likely to remain in water indicating not be B or vB.  In addition the predicted bioaccumulation factor is extremely low at 57.52 L/kg.  This is well below the > 2000 L/kg threshold which again indicated not B or vB.

 

With respect to the persistency, screening tests indicate that the substance is not readily biodegradable. The predicted (EPI suit) Biowin 3 degradation rate is 2.6 (weeks - months) and is above the 2.2 months probability threshold and is an indication of P or vP.  Other EPI suit predictions also confirm the indication that the substance does not biodegrade readily. The Biowin 5 and Biowin 6 probabilities are below 0.5 (estimated probability 0.28 and 0.2 respectively) giving an indication that the substance will not biodegrade fast.  Biodegradability testing in accordance with OECD 301B indicates a mean value of 50 – 60% degradation after 28 days. This is an indication that 3,3 diphenylpropiononitrile  is partly or moderately biodegradable, supporting the Biowin predictions that the substance is not readily biodegrdable.  Based on the EPI suit predictions and testing substance must be considered P or vP. 

 

The substance 3,3 diphenylpropiononitrile  is not classified as carcinogenic (cat 1A or 1B), cell mutagenic (category 1A or 1B) or toxic for reproduction (category 1A, 1B or 2) in accordance with EC No. 1272/2008. Test on Daphnia magna carried out in accordance with OECD 202 test method indicate the EC50 (48 h) is >100 mg/l. The substance cannot be classified as toxic to the environment.

The environmental assessment for 3,3 diphenylpropiononitrile  does not meet all three criteria of persistency, bioaccumulation and toxicity and therefore not classification as PTB or vPTB.
