Remarks:
Isodecyl benzoate was originally classified as Xn, R20 by the original notifier, which led the UK to propose this classification for inclusion in Annex I to 67/548/EEC. Following submission of new data to the European Commission and Member States in October 2008, the Technical Progress Committee concluded at their meeting of November 19, 2008 that classification is not required and that Isodecyl benzoate should not be included in the 31st ATP to Directive 67/548/EEC. Unfortunately due to a clerical error the substance was still included. This clerical error was subsequently corrected in the 1st ATP to the Classification, Labelling and Packaging Regulation (Commission Regulation (EC) No 790/2009). Recital 7 of this regulation clearly states: "The published version of Directive 2009/2/EC [31st ATP] mistakenly contained entry No. 607-674-00-0 (branched C10-alkyl benzoates), therefore, it is appropriate to correct this clerical error and not include this entry in Annex VI to Regulation (EC) No 1272/2008 [Classification, Labelling and Packaging Regulation]”.
