Registrants and notifiers to update their dossiers according to the provisions of the second ATP to CLP

ECHA reminds companies that the classification, labelling and packaging provisions of the second ATP (Adaptation to Technical and scientific Progress) amending the CLP Regulation must be applied to substances by 1 December 2012.

Helsinki, 28 September 2012 – The second ATP contains inter alia amendments concerning new subcategories for the hazard classes of respiratory and skin sensitisation, a revision of the classification criteria for aquatic chronic toxicity and a new hazard class for classification: "hazardous to the ozone layer". Companies are requested to classify, label and package their substances in compliance with the new provisions as well as update their REACH registration dossiers and notifications to the C&L Inventory by 1 December 2012.

A transitional provision is envisaged for substances placed on the market before 1 December 2012 and classified, labelled and packaged according to the CLP Regulation. In accordance with the second ATP, these substances do not require relabeling and repackaging until 1 December 2014.

The second ATP applies to mixtures only from 1 June 2015. However, in accordance with the second ATP, mixtures placed on the market before 1 June 2015 and classified, labelled and packaged in accordance with the CLP Regulation or the Dangerous Preparations Directive, are not required to be relabelled and repackaged until 1 June 2017. 

All provisions contained in the second ATP can be voluntarily applied by companies before the set deadlines.
