Draft ECHA recommendations for inclusion of substances in the list of substances subject to authorisation

In the framework of the authorisation process under REACH the European Commission will adopt decisions to include substances in Annex XIV (Authorisation List) that appear on the Candidate List of Substances of Very High Concern for Authorisation. Decisions to include substances in Annex XIV will be based upon recommendations from ECHA, taking into account the opinion of the Member State Committee.

The first recommendation of substances to be included in Annex XIV has to be submitted by ECHA to the Commission by 1 June 2009. Further recommendations need to be made at least every other year.

As a first step in preparing a recommendation ECHA needs to determine which substances appearing in the Candidate List should be prioritised for inclusion in Annex XIV.

As a second step, ECHA has to prepare for each prioritised substance a draft recommendation for inclusion in Annex XIV specifying the date from which the use of the substance is prohibited unless an authorisation is granted (i.e. the "Sunset Date"), the application date by which applications for authorisation must be received and uses or categories of uses exempted from the authorisation requirement if any.

As a third step ECHA has to make its draft recommendation publicly available inviting interested parties to submit comments within three months of the date of publication on its website. For its first recommendation ECHA will also invite comments on ECHA's justification for prioritising substances in its draft recommendation. On the basis of the comments received ECHA may modify the draft recommendation taking into account the opinion of the Member State Committee before it submits its recommendation to the European Commission.
